One could argue that his past history would prove depraved indifference, maybe, but I doubt those past incidents were allowed into court.  This would be, at least, vehicular manslaughter, but he is a minor and they are assumed to lack certain cognitive abilities at that age.  Not knowing all of the testimony it seems a bit absurd to think one could pass judgment.
