Can you explain how the PPACA penaltax is not a direct tax that is NOT apportioned among the several states?

In order to make the income tax (another direct tax not apportioned among the several states) legal, the 16th Amendment needed to be passed and ratified.

How can the PPACA penaltax be legal?

Direct TAXES were put into our constitution or did you not understand this;

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons
Explain to me how the PPACA penaltax is apportioned among the several states, based on population?

It seems to me this tax is levied directly on individuals, with no regard to what state they reside in or the population of that state.

The only way the federal government was able to create an income tax, a direct tax on individuals without regard for their state of residence or its population, was to ratify the 16th Amemdment.

If this is true, the PPACA penaltax must be an illegal direct tax according to our Constitution.

It is direct taxes AZ and income tax was what I was aiming at!

Obviously a direct tax has been legal from the start;

Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons
